Terms of service

In this agreement:

(a) The photographerwe, our or us means BMA Photography.

(b) The Client, you or your means any business or person who engages us to provide products or services.

All services performed and digital/artworks provided are strictly on the basis of the terms and conditions set out in this Agreement unless otherwise agreed in writing with us.

By booking our services this confirms your acceptance of the terms and conditions set out in this Agreement.

To the extent permitted by law, we reserve the right to amend this Agreement at any time. The updated Agreement will be available on our website.

Booking Confirmation:

  • To confirm your session booking, a non-refundable deposit of 25% of the total session fee is required at the time of booking.

  • This secures your appointment with us and prevents us from making any other bookings for this time.

Payment Terms:

  • Full payment must be received before the final images are delivered. No images will be released until all outstanding balances are paid in full.

Session Duration:

  • The family/graduation package session is scheduled for 30 minutes. (unless otherwise specified in the package). Please arrive on time, as the session will begin and end as per the agreed schedule. Late arrivals may result in reduced shooting time without adjustment to the fee.

Travel Fees:

  • A travel fee of $30 will be applied for locations selected by the client that are more than 15km from Central Auckland. Additional travel fees may apply for locations further away.

Delivery of Final Product:

  • The family/couple package will include 15 edited high resolution photos.

  • The graduation package will include 15 edited high resolution photos.

  • The Photographer will provide the Client with a gallery of images from the session, from which the Client will select 15 images for professional editing (depending on the package selected).

  • Initial edits of selected images will be delivered to the Client for review within 2-3 business days. The final edited images will be delivered within 4-5 business days after the Client’s approval. Any delays in Client feedback may result in an extension of the delivery timeline.

  • Final images will be delivered in high-resolution digital format, via an online gallery or download link.

  • The Client has 24 hours to review and request any revisions. After this period, the images will be considered accepted. You may not amend your order at this stage. All orders are final.

Additional Packages:

  • The Client has the option to purchase additional images beyond the initial package.

  • For every single image above the allocated 15, an additional $5 fee will apply.

  • For example, if the Client selects a total of 22 images for editing (15 included in the original package and 7 additional images), an additional charge of $35 will be added to the final package cost.

  • On bulk additions, for every set of 30 additional images selected for editing, a fee of $75 will be applied (at a discounted $2.50 per photo)

  • For instance, if the Client selects a total of 75 images for editing (15 included in the original package and 60 additional images), an additional charge of $150 will be added to the final package cost.

  • BMA do not offer “full gallery” options, and all additional photos separate from packages will be charged as listed.

Retouching and Editing:

  • The photographer takes no responsibility for the artistic quality of the photographs where there are factors outside our control (for example, poor choices of clothing, make-up, hair, or weather-related issues)

  • Images may be retouched at our discretion. If significant additional retouching is requested (for example, head swap, fixed ties, creases out of pants, slimming - this is classed as advanced retouching) it shall be charged at $50 per image.

  • The Client must raise any issues with the images at the review stage. If further retouching is required, you will be emailed the artwork to approve the amendments.

Social Media and Portfolio Usage:

  • The Photographer may use images from the session for marketing or portfolio purposes, including on social media, unless otherwise requested by the Client at the time of booking.

Rescheduling Due to Weather:

  • If adverse weather conditions make it impractical to proceed with the photoshoot, the session may be rescheduled at no extra charge.

  • The Photographer will collaborate with the Client to select a new date that is mutually convenient.

  • The decision to reschedule will be made with consideration for the safety and quality of the session, and the Client will be notified promptly.

Rescheduling and Cancellations:

  • Sessions may be rescheduled or cancelled in the event of a family emergency, or if a minimum of 48 hours notice is provided prior to the session date. In such cases, any fees paid beyond the deposit will be refunded.

  • Please note that the deposit remains non-refundable.

  • If you are unwell, we kindly request that you reschedule your session at least 48 hours prior to the scheduled date.

  • If you arrive more than 25 minutes late to your session, your session will be deemed to be cancelled and a cancellation fee will be charged.

  • If the photographer has to cancel or postpone your appointment, we will give you as much notice as practically possible and make reasonable endeavours to reschedule to a mutually convenient time.

Photographer’s Rights:

  • The photographer reserves the right to terminate or leave the session if the client is unwell and has not provided prior notice, or if the photographer feels unsafe in the given situation.

  • The photographer reserves the right not to provide RAW or unedited photos under any circumstances. All delivered images will be professionally edited to ensure they meet the quality standards of the photographer's work.
